1. Acceptance of Terms
By accessing and using SpartAI ("the App"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this App.
2. Description of Service
SpartAI is a fitness and nutrition tracking application that provides:
- AI-powered fitness coaching and recommendations
- Meal tracking and nutritional analysis
- Workout planning and logging
- Progress tracking and analytics
- Barcode scanning for food items
The App is designed for informational purposes only and is not intended to replace professional medical advice, diagnosis, or treatment.
3. Medical Disclaimer
IMPORTANT: SpartAI is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.
- Always consult with a qualified healthcare provider before starting any diet, exercise program, or taking any dietary supplements.
- If you experience any pain, discomfort, or other symptoms during exercise, stop immediately and consult a healthcare professional.
- The calorie and nutritional information provided are estimates and may not be accurate for all individuals.
- Individual results may vary based on your personal health condition, metabolism, and adherence to recommendations.
4. User Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these terms.
- You must be at least 16 years of age to use this App.
5. Subscription and Payments
- Some features of SpartAI require a paid subscription ("SpartAI Pro").
- Subscriptions are billed in advance on a monthly or annual basis.
- You may cancel your subscription at any time through your App Store or Google Play account settings.
- Refunds are handled according to Apple App Store or Google Play Store policies.
- Free trials, if offered, will automatically convert to paid subscriptions unless cancelled before the trial period ends.
- We reserve the right to change subscription prices with reasonable notice.
6. Referral Program
Eligibility
- You must have an active SpartAI account to participate in the referral program.
- Referred users must be new users who have never had a SpartAI account.
- Self-referrals (referring yourself with a different account) are prohibited and may result in account termination.
Qualifying Referrals
- A referral is considered "qualified" when the referred user subscribes to a paid plan.
- Annual subscriptions: Referral qualifies after 30 days of active subscription without refund.
- Monthly subscriptions: Referral qualifies after 14 days of active subscription without refund.
Rewards
- For each qualifying annual referral: You receive 1 month of free subscription time.
- For each qualifying monthly referral: You receive 1 week of free subscription time.
- Rewards are applied as credits to extend your current subscription period.
- Rewards have no cash value and cannot be transferred or exchanged.
Referred User Benefits
- Annual subscription: 20% discount on first year.
- Monthly subscription: First week free.
Clawback and Revocation
- If a referred user receives a refund or cancels within the qualification period, no reward is granted.
- If a reward has already been credited and the referred user subsequently receives a refund, the reward may be deducted from your account balance.
- SpartAI reserves the right to withhold or revoke rewards for fraudulent activity, including fake accounts, manipulation, or abuse of the program.
Program Modifications
- SpartAI may modify, suspend, or terminate the referral program at any time without prior notice.
- Changes to reward amounts or qualification criteria are effective immediately upon posting.
- Existing qualified referrals will be honored under the terms in effect at the time of qualification.
7. User Content
- You retain ownership of any content you submit to the App (photos, meal logs, etc.).
- By submitting content, you grant us a license to use, store, and process it for providing our services.
- You agree not to submit content that is illegal, harmful, or violates third-party rights.
- We may remove content that violates these terms without notice.
8. Intellectual Property
- The App and its original content, features, and functionality are owned by SpartAI and protected by international copyright, trademark, and other intellectual property laws.
- You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
- The SpartAI name, logo, and all related names, logos, and slogans are trademarks of SpartAI.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- SpartAI is provided "AS IS" without warranties of any kind.
- We do not guarantee the accuracy, completeness, or usefulness of any information in the App.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability shall not exceed the amount you paid for the App in the past 12 months.
10. Changes to Terms
- We reserve the right to modify these terms at any time.
- We will notify users of significant changes through the App or via email.
- Your continued use of the App after changes constitutes acceptance of the new terms.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
